Your election officials have done their very best to conduct an officer election according to the requirements of your constitution, bylaws, and federal law.
Despite all of their efforts, one of your members has filed an election protest.
If you have ever been in this situation, then you understand the need for a qualified, independent service to investigate the election protest and present you with choices on how to proceed.
BallotPoint will conduct a review of your officer election protest that will include the following steps:
- Determine if the complainant was a member in good standing when the challenge was filed.
- Determine if the complainant followed the procedures established in your constitution and bylaws.
- Determine if the complainant is eligible to file a complaint with DOL.
- Identify all of the issues contained in the member’s initial protest and subsequent appeals.
- Interview the complainant, principal officer(s), election committee chair and other parties with relevant information.
- Conduct a cursory review of election records.
- Document our investigative findings, and explain how DOL is likely to interpret them.
- Recommend any necessary additional investigation.
We will tell you if we think additional investigation is necessary and will offer to assist you in resolving any outstanding issues in anticipation of a DOL investigation.
